The following provisions establish the general terms and conditions of sale for the products sold by NADISTANBULOVE on her website at the following address : www.nadiadafri.com

 

The Customer must read these terms and conditions before any order. The general terms and conditions of sale applicable to the user are those in force on the day of their order. NADISTANBULOVE reserves the right to adapt or modify these terms and conditions at any time.

 

These terms and conditions only affect physical persons, not business customers.

 

 

 

Article 1 - PURPOSE

The products for sale are those described on the site on the day the internet user views the site, subject to available stocks.

 

The products are presented and described as accurately as possible, to best inform the Customer. If there are any errors in these descriptions the company, NADISTANBULOVE, cannot be held liable. The photos and descriptive texts illustrating the products are not contractual.

 

It is possible that the materials’ colours and finishes may differ between what you see on the screen and in real life. The products manufactured by hand may feature slight variations.

 

In any case, in the event a product delivered does not comply with the description on the website, the Customer may exercise their right of withdrawal, or request a replacement product, or request a (full or partial) refund for the invoiced product.

 

As returns are free-of-charge, it is possible that you may receive a product that was previously returned by another person. Only undamaged and unworn products are accepted, they are carefully checked before being returned to stock.

 

 

 

Article 2 - PRICES

The prices of our products are indicated in euros including all taxes (VAT and other applicable taxes on the day of the order), unless otherwise indicated and excluding processing and delivery fees.

 

All orders, wherever they are made, are payable in euros.  The company NADISTANBULOVE reserves the right to modify its prices at any time, but the product will be invoiced per the current price when confirming the order and subject to availability.

 

PLEASE NOTE: The products remain the property of NADISTANBULOVE until full payment of the price.   As soon as the buyer takes physical possession of the ordered products, the risks of loss or damage to the products are borne by the buyer.

 

Article 3 - IMPORT DUTY

For orders sent to countries outside Turkey, you are the importer of the product or products concerned. Customs duties or other local taxes or import duties or state taxes may apply. These duties and sums are not the responsibility of NADISTANBULOVE. It is up to you to declare the goods to the authorities concerned and pay the necessary duties in your country. We advise you to inquire about these aspects with your local authorities.

Article 4 - ORDERS

NADISTANBULOVE reserves the right to not register a payment, and to not confirm an order for any reason, particularly in the event of supply problems or in the event of difficulties with the order received. NADISTANBULOVE may in no way be held liable for this.

All orders made via the website www.nadiadafri.fr constitute your agreement with these general terms and conditions. Confirmation of an order implies unreserved acceptance, without exception, of these general terms and conditions of sale. 

 

Article 5 - PAYMENT

Confirmation of your order means you are under obligation to pay the indicated price.  

You may pay for your purchases using a card (Visa, MasterCard, debit card, credit card) or your account, via a secure payment service.

When we receive your order, we will place a hold on funds corresponding to the total amount of your order on your Visa, MasterCard, debit or credit card. If the hold placed on your card is authorised by your bank or issuing company, we will debit the amount for the products from your card on sending all or part of the products ordered.

Please note that the act of placing a hold on funds on your card (Visa, MasterCard, credit card, debit card) does not constitute acceptance of your order.  Our contract is only established when we send you an email confirming that we have send all or some of the products in your order.

 

6  RETURNS

our products are all handmade, so variations in size and colour are to be expected. We do not accept returns based on these irregularities or in the following cases.

If, for any reason, you are not satisfied with your NADISTANBULOVE product, you may return the unused, re-sellable product to us in perfect condition and in its original packaging within 14 days of receipt; with the tracking code sent after shipment. Once the products have been received and inspected by us, and if your claim is accepted, we will refund you the amount using the same method as that used for payment.

Please ensure that the returned items are well packaged so that they are not damaged.   Clearly mark the package ‘RETURNED GOODS’ to avoid customs charges. NADISTANBULOVE is not responsible for customs fees related to returns.

Products are the responsibility of the customer until they reach their destination.

PLEASE NOTE:

•       Any damaged item about which we received no remarks or express reservations from the customer upon delivery will be refused.

•       The shipping costs of your initial order are not refundable. Only items will be refunded.

 

7 NON CONFIRMING PRODUCTS

If you have received a defective and/or non-conforming product, we ask you to report any defect or non-conformity of the products within 7 days of receipt of your purchase.

We ask you to contact our customer service department, clearly indicating the defect, preferably accompanied by photographs, and enclosing the order confirmation.

Once we have received the information, we will assess the request and help you find a solution. We will refund you in full, in part or send you a replacement for the faulty product.

If NADISTANBULOVE takes the step to provide you with a refund, we will refund your payment to your account as soon as possible and no later than 14 days following the assessment of the faulty product.

 Refunds are transferred to the payment card with which the purchase was made. NADISTANBULOVE may ask you to provide bank details, if necessary, in order to process the refund accordingly. On a case-by-case basis, we will advise you whether it is necessary to return products to our warehouse. If it is necessary to return the product to the warehouse, NADISTANBULOVE will cover the return shipping costs.

8 DELIVERY

We work with DHL Worldwide Express to ship all international orders. 

Orders are shipped within 5 working days and may take up to 10 days to be delivered. Please be aware that local customs may withhold your package, therefore may cause delays in delivery time.

The shipping fee for international orders is based on the country where the order will be shipped. Your shipping fee is calculated after you enter your address as you complete your purchase. 

9 CUSTOM CHARGES

Some countries might be subject to customs and taxes upon delivery which will be customer’s responsibility. Unfortunately, we have no control over these charges, and cannot notify you about what the cost might be, as customs policies and import duties vary from country to country.

The customer must take full liability for any parcels returned to us due to unpaid customs charges. Please check with your DHL Express services in your country before you place an order.

After the package is marked as delivered by the courier, packages become the customer’s responsibility. Nadistanbulove  cannot provide refunds for lost or stolen packages post-delivery. 

Missing packages claims must be filed by the customer. In the rare case of missing parcels, please contact us via our contact page form.

 

10 RESPONSIBILITY

The products sold comply with current turkish laws. NADISTANBULOVE cannot be held responsible in case of non-respect of the legislation in the country where products are delivered. You must check with the local authorities the possibility of importing or using the products or services you plan to order. 

Furthermore, NADISTANBULOVE cannot be held liable for damage resulting from misuse of the product bought.

 

11 SIGNATURE 

All international packages require a signature upon delivery; a tracking number will be provided once your order is shipped.

 

 

12 - APPLICABLE LAW IN THE EVENT OF DISPUTE

The language of this contract is turkish. These terms and conditions of sale are governed by turkish law. In the event of litigation, matters may only be settled in a Turkish court.

  

13 - INTELLECTUAL PROPERTY

All content of the site, including texts, pictures and photos, are and shall remain the exclusive intellectual property of NADISTANBULOVE. It is strictly forbidden to reproduce, exploit, redistribute or reuse for any purpose, even partially, any material from the website whether software, visual or audio. Any simple or hypertext link is strictly forbidden without express written agreement from NADISTANBULOVE and constitutes infringement.

 

Article 14 - PERSONAL DATA

NADISTANBULOVE collects nominative information and personal data required to handle your order. All this information is processed with the utmost confidentiality.

This information and data is also saved for security reasons, to comply with legal and regulatory requirements. You have the right to access, modify or delete nominative information and personal data about you, directly on the website. 

 

Article 15 -  ARCHIVING

NADISTANBULOVE will archive purchase orders and invoices on a reliable and durable medium which constitutes a true copy.  The computerised databases of NADISTANBULOVE will be considered by all parties involved as proof of communications, orders, payments and transactions between the parties.
